Terms of Service Agreement

Effective Date: February 13, 2026

This Terms of Service Agreement ("Agreement") governs your use of services provided by Nationwide Screening Solutions, doing business as RegainMyCDL.com ("Company," "we," "our," or "us").

By submitting your information, enrolling in services, making payment, or accessing our website, you acknowledge and agree to be legally bound by this Agreement.

If you do not agree, you must not use our services.


1. Verification of Identity and Accuracy of Information

By enrolling in services, you certify and affirm that:

You are the individual whose information is being submitted, or you are authorized to act on behalf of the individual or company.

All information provided is true, accurate, and complete.

You will not submit false, misleading, or fraudulent information.

Providing false information may result in immediate termination of services without refund and may be reported to appropriate regulatory authorities where required.


2. Authorization for Consortium / Third-Party Administrator (C/TPA) Services

By enrolling in consortium or compliance services, you authorize Nationwide Screening Solutions to act as your designated Consortium/Third-Party Administrator (C/TPA), where applicable and legally permitted.

This authorization allows Nationwide Screening Solutions to perform administrative compliance functions including, but not limited to:

Conducting FMCSA Clearinghouse queries as permitted by law

Coordinating Return-to-Duty (RTD) compliance requirements

Managing drug and alcohol testing program enrollment

Maintaining required compliance records

Coordinating required testing and reporting with authorized entities

This authorization remains valid for the duration of your enrollment, unless revoked in writing where legally permitted.

Refusal to provide required consent may prevent completion of compliance services.


3. Clearinghouse and Regulatory Compliance Acknowledgment

You understand and acknowledge that:

Nationwide Screening Solutions does not control FMCSA Clearinghouse records or regulatory decisions.

Regulatory status changes are determined solely by FMCSA, DOT, employers, and authorized regulatory entities.

Certain compliance steps, including follow-up testing and safety-sensitive duty eligibility, may require employment with a DOT-regulated employer.

If you are an owner-operator or self-employed driver, you understand you are responsible for maintaining valid DOT registration where required.

If you are not affiliated with an employer, certain regulatory requirements may only be completed once employment is obtained.


4. Authorization for Release of Compliance and Health Information

Where necessary to provide compliance services, you authorize authorized third parties, including Substance Abuse Professionals (SAPs), Medical Review Officers, laboratories, and compliance platforms, to release relevant compliance-related information to Nationwide Screening Solutions.

This may include:

Compliance status updates

Evaluation completion confirmation

Testing requirements and follow-up schedules

Documentation necessary to administer compliance programs

This authorization applies solely for compliance administration purposes.


5. No Guarantee of Regulatory Outcome or Employment

Nationwide Screening Solutions provides administrative and compliance support services only.

We do not guarantee:

Removal from prohibited status

Clearinghouse status changes

Return-to-Duty approval

CDL reinstatement

Employment placement

Employer hiring decisions

All regulatory outcomes are determined exclusively by authorized regulatory agencies and employers.


6. Drug Testing and Compliance Responsibility

You acknowledge that compliance success depends on your ability to meet regulatory requirements.

If you:

Fail a required drug or alcohol test

Refuse a required test

Provide invalid samples

Fail to comply with regulatory requirements

You may be required to repeat portions or all of the compliance process, and additional fees may apply.

Nationwide Screening Solutions is not responsible for failed tests or regulatory non-compliance.


7. Payment Terms and No Refund Policy

By purchasing services, you agree that:

All fees compensate for administrative services, compliance coordination, expertise, and system access.

Services begin immediately upon purchase or enrollment.

All sales are final.

Services are:

Non-refundable

Non-cancellable

Non-transferable

No refunds will be issued based on:

Failure to complete compliance requirements

Regulatory outcomes

Personal circumstances

Employment status

Failure to follow instructions


8. Chargebacks and Payment Disputes

You agree not to initiate payment disputes or chargebacks for services that have been delivered, initiated, or made available.

Nationwide Screening Solutions maintains detailed records including:

Enrollment records

Signed agreements

Compliance activity logs

Communications

Transaction records

These records may be used to dispute chargebacks and protect the Company’s legal and financial interests.

Fraudulent chargebacks may be subject to legal action.


9. Communication Consent

By enrolling in services, you consent to receive communications from Nationwide Screening Solutions, including:

Phone calls

Emails

SMS messages

These communications may include:

Compliance notifications

Service updates

Appointment reminders

Account notifications

Message frequency varies. Message and data rates may apply.

You may opt out of SMS communications by replying STOP.

Compliance-related communications may still be required.


10. Limitation of Liability

To the maximum extent permitted by law, Nationwide Screening Solutions shall not be liable for:

Regulatory decisions

Clearinghouse status

Employer decisions

Loss of employment

CDL suspension or reinstatement decisions

Third-party actions or delays

Indirect, incidental, or consequential damages

Total liability shall not exceed the amount paid for services.


11. Right to Refuse or Terminate Service

Nationwide Screening Solutions reserves the right to refuse or terminate services at any time for reasons including but not limited to:

Fraud or suspected fraud

Abuse or harassment

False or misleading information

Non-cooperation

Violation of these Terms

Termination does not entitle you to a refund.


12. Privacy and Data Protection

Your information is handled in accordance with our Privacy Policy.

We do not sell your personal information.

Information is used solely for compliance, service delivery, and legal obligations.


13. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Colorado, without regard to conflict of law principles.

Any legal disputes shall be resolved in the appropriate courts located within Colorado.

Carriers are not responsible for messages

Users must be 18 years of age or older.
